=== ACR 211 === RESOLVED by the Assembly of the State of California, the Senate thereof concurring, That in order to improve the ability of all Californians who choose to walk or bicycle to do so safely and efficiently, the Legislature of the State of California hereby encourages all cities and counties to implement the policies of the California Department of Transportation Deputy Directive 64 and the United States Department of Transportation's design guidance document on integrating bicycling and walking when building their transportation infrastructure. Caltrans Deputy Directive 64: The needs of non-motorized users are fully considered in all programming, planning, maintenance, construction, operations and project development activities and products. This includes adopting the best practice concepts in the USDOT Accommodating Bicycle and Pedestrial Travel: A Recommended Approach: USDOT document: http://www.fhwa.dot.gov/environment/bikeped/Design.htm Accommodating Bicycle and Pedestrian Travel: A Recommended Approach is a policy statement adopted by the United States Department of Transportation. USDOT hopes that public agencies, professional associations, advocacy groups, and others adopt this approach as a way of committing themselves to integrating bicycling and walking into the transportation mainstream. The Design Guidance incorporates three key principles: 1. a policy statement that bicycling and walking facilities will be incorporated into all transportation projects unless exceptional circumstances exist; 2. an approach to achieving this policy that has already worked in State and local agencies; and 3. a series of action items that a public agency, professional association, or advocacy group can take to achieve the overriding goal of improving conditions for bicycling and walking. === United States Code, Title 23, Chapter 1, Subchapter I, § 109 Standards, (m) === Protection of Nonmotorized Transportation Traffic: The Secretary shall not approve any project or take any regulatory action under this title that will result in the severance of an existing major route or have significant adverse impact on the safety for nonmotorized transportation traffic and light motorcycles, unless such project or regulatory action provides for a reasonable alternate route or such a route exists. === CA Streets and Highway Code 888 === The department shall not construct a state highway as a freeway that will result in the severance or destruction of an existing major route for nonmotorized transportation traffic and light motorcycles, unless it provides a reasonable, safe, and convenient alternate route or such a route exists. === CA CVC 21949 === (a) The Legislature hereby finds and declares that it is the policy of the State of California that safe and convenient pedestrian travel and access, whether by foot, wheelchair, walker, or stroller, be provided to the residents of the state. (b) In accordance with the policy declared under subdivision (a), it is the intent of the Legislature that all levels of government in the state, particularly the Department of Transportation, work to provide convenient and safe passage for pedestrians on and across all streets and highways, increase levels of walking and pedestrian travel, and reduce pedestrian fatalities and injuries.
